Auror Platform Terms of Use

Welcome to the Auror community! Before you start using the Auror platform, please carefully read and agree to these important terms - they set out your legal rights and obligations and create a binding agreement between you and Auror. If you don’t agree to our Terms of Use then you won’t be able to use the Auror platform.

We’ve tried to explain everything as simply as possible but if you have any questions then please contact us at support@auror.co.

Key things for you to understand

Here are some of the most important things to be aware of when you use the Platform:

1. Your Access and Use

Here are some important definitions to understand and information on what rules apply to your use of the Platform.

1.1 You, Auror and the Platform: When we say “you” or “your”, we mean both you and your employer or the organization that has authorised your access to the Auror platform. “Auror”, “we”, “our” or “us” refers to Auror Limited, the owner of the Auror platform, and its subsidiaries. The “Platform” means the Auror platform that enables users to report, solve, and prevent crime, and includes the web app, mobile app, the local software client and all associated services. “Users” refers to everyone who accesses and uses the Platform.

1.2. Rules that apply to your use of the Platform: Your organization may also have a separate agreement with us that governs your use of the Platform. You may also have internal policies that apply to how you use the Platform that you need to abide by. Please familiarise yourself with all of the requirements that apply to you before you access the Platform (and from time-to-time thereafter, as necessary).

1.3. Your agreement to these Terms: Your access and use of the Platform is subject at all times to your compliance with these Terms of Use (the “Terms”), which you must accept and agree to by clicking “accept” in the pop-up box where prompted or by otherwise accessing or using the Platform. If you don’t agree to these Terms then you must not access or use the Platform.

1.4. Access rights: You may access and use the Platform in line with the user role(s) allocated to you by your organization. Those rights are specific to you and can’t be transferred to anyone else. Subject to your continued acceptance of these Terms, you will be able to access the Platform for as long as the relevant fees are paid by your organization (if any), until your organization’s access is terminated, or until your access is revoked.

1.5. New functionality or services: We are always developing and improving the Platform for our Users. Where this involves new or updated functionality, there may be additional requirements that you’ll need to understand and comply with prior to accessing the relevant functionality on the Platform. We will let you know what those requirements are before you start using those services. Please also see the “Important Housekeeping” section below for more information about changes to these Terms.

2. Your Information and Responsibilities

You own any information about yourself you add to the Platform and your organization owns any other information that you add to the Platform. Your organization may choose to share your information with trusted third parties and Law Enforcement agencies.

Auror provides the Platform to your organization for your use. Auror (and its subcontractors) is considered a data processor or service provider, and does not own, use (other than as below for providing you the Platform and required services), nor sell the data collected.

2.1. It’s your or your organization’s information: All of the information that you enter on the Platform is either owned and controlled by you (in the case of your own personal information) or your organization in the case of other data that you enter in your official capacity. Auror is generally a custodian and processor of that data only., but in certain cases we may act as a joint controller with your organization to surface high level aggregated insights or suggested profile merges using the information you enter into the Platform. You give us permission (and represent that your organization permits us) to use, copy, transmit, store, analyse, create derivative works from, back up and display all of the data you submit to the Platform, including any personal information of yourself and others, so we can:

  • provide the Platform and enable you to use it

  • continue to improve, develop and protect the Platform, including developing new services and functionality

  • generate insights

  • communicate with you

  • send you relevant information like daily updates and real-time alerts and notifications.

2.2. Your responsibilities: You and your organization are responsible (meaning we’re not liable) for complying with applicable laws at all times and for all activities that occur under your account and your use of information on the Platform, including any actions you take - or don’t take - as a result. You and your organization are also responsible for all of the information, images, videos, comments or other material that you add to the Platform, including personal information (User Content). When you contribute any User Content to the Platform, you automatically:

  • warrant that you are the owner of that User Content or are otherwise authorized to share such User Content, and your collection methods for any personal information are fully compliant with all applicable privacy laws in your jurisdiction; and

  • grant us full rights to use any User Content necessary for operation of the Platform and the purposes set out in these Terms.

2.3. Confidentiality: As information on the Platform may be sensitive, you must not share any Platform content with anyone who isn’t a registered User or provide them with access to the Platform, including using your login details.

2.4. Your use and sharing of information: Only registered Users can access the data on the Platform - it can’t be accessed or viewed by the general public. Information that you enter in the Platform is automatically shared with other Users in your organization. You and your organization may also choose to share information with other trusted organizations, including Law Enforcement agencies. That information can be used to:

  • prevent further events from occurring

  • identify repeat offenders and organised crime groups

  • notify Law Enforcement agencies or your organization that an event has occurred

  • send alerts to any sites you are sharing with in areas that alleged offenders may target next

  • share information with other trusted third parties

  • investigate an event (including by Law Enforcement agencies) or as evidence in a court of law

  • research crime patterns and behaviours.

2.5. No disclosure outside the Platform: As information on the Platform is often sensitive, you can’t give anyone who isn’t a registered User access to the Platform and you can’t share any Platform content outside the Platform (like on social media) or with anyone who isn’t a registered User, except where you are working on an investigation with colleagues who are not registered Users but have been given access to the Auror-Investigate module and provided they only use the information for the purposes of that same investigation.

2.6. Law Enforcement agencies sharing: If you are a retailer User, Law Enforcement agencies in your area may also share information with you by commenting on your User Content.

2.7. What we don’t do on the Platform: We do not - and we won’t ever - use or allow the information on the Platform to be used for any racial profiling purposes. We also don’t on-sell information on the Platform or any personal information to advertisers or third parties.

3. Do’s and Don’ts

This really important section sets out how you can - and can’t - use the Platform and the information on it. Please also see our Community Guidelines in the Help Center.

3.1. Only use the Platform to fight crime: You can only use the Platform to deter, identify, investigate and prevent crime. You can’t use it for any unlawful purpose, to commit fraud or any other illegal act, or just to look up people you know. All actions on the Platform are logged and auditable and may be shared with your organization. If you access or use the Platform for any other reasons, your access may be suspended or terminated.

3.2. Be respectful: Being part of the Auror community involves a commitment to respect each other and the people in our wider communities. That includes not:

  • violating any applicable law or any third party’s intellectual property rights

  • abusing, denigrating or being disrespectful to another user, Auror employee, or individual whose information appears on the Platform

  • contributing any User Content that is or may be considered deceptive, fraudulent, illegal, obscene, pornographic, defamatory, threatening, hate speech, harassment, or stalking

  • impersonating anyone or pretending that you are associated with a person or entity in a way that is intended to mislead, confuse or deceive

  • posting any User Content that contains information you don’t have a right to make available under law or any contractual or other duty.

3.3. Add accurate information: You must make sure any User Content you upload to the Platform is accurate, up to date, relevant and not misleading. Please ensure you use the free text fields responsibly and appropriately, specifically in relation to sensitive information (e.g. race or ethnicity, political (or otherwise) memberships, religion, sexual orientation, health or criminal records, or otherwise as your relevant privacy laws dictate).

3.4. In particular, you must have clear evidence of any event that has taken place before uploading that event to the Platform (like reasonable quality photos or video footage).

3.5. Maintain security: Security is critical to the operation of the Platform so you must keep your Platform access information private and secure and not share it with anyone. You must not:

  • interfere with the proper working of the Platform in any way or attempt to undermine its security or integrity or related systems

  • introduce or upload anything to the Platform that might compromise it or anyone downloading information from the Platform, including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other malicious code or harmful material

  • use the Platform in any way that might impair functionality or interfere with others’ use of the Platform

  • access the Platform or any related system without permission or appropriate access rights

  • Use any scraping, deep-linking, harvesting, data mining, robot or spider, automation or any similar data gathering, extraction or monitoring method on the Platform.

3.6. Inappropriate User Content: If your User Content breaches these Terms, then you may be legally responsible for that material. We don't routinely review, screen, monitor or approve User Content so we can’t and don’t guarantee its accuracy, completeness or integrity. Please report to us immediately if you encounter any User Content that you believe is inaccurate, objectionable, unlawful, defamatory, offensive or that otherwise breaches these Terms. While we aren’t responsible for User Content on the Platform, we reserve the right to monitor, hide, refuse or remove any User Content from the Platform that we believe doesn’t comply with these Terms or our Community Guidelines, or that is otherwise objectionable, unlawful, defamatory, unnecessary or offensive.

4. Law Enforcement

Law Enforcement agencies and Law Enforcement Users have the following additional responsibilities when using the Platform. Please read this section carefully.

4.1. Trusted use: The Platform provides you with access to information and insights for the sole purpose of using it to deter, identify, investigate, solve and prevent crime to keep your community safe. You have been trusted with access to the Platform and must use it in a lawful, responsible, safe and secure way at all times.

4.2. You are responsible for what you do: Organizations have the option of choosing whether or not they want to share information with your Law Enforcement agency. You are responsible for any actions that you decide to take - or not take - based on information in the Platform. You need to ensure that any information from the Platform is accurate and up to date before you rely on it in your investigations. Please be aware that the Platform can be audited to identify any misuse.

4.3. Information sharing: As information on the Platform is often sensitive, you can’t give anyone who isn’t a registered User access to the Platform and you can’t share any Platform content with them unless you have already got permission from the organization that owns the material, except where you are working on an investigation with colleagues who are not registered Users and provided they only use the information for the purposes of that same investigation.

4.4. If you want to publicly share any information from the Platform, including without limitation on social media platforms or messaging services, you must first get written consent from the organization that owns that information. This includes if you want to share the names of any organization using the Platform.

4.5. You must respect any sharing restrictions: Depending on your jurisdiction, there may be additional restrictions on who can share information with (including other Law Enforcement Agencies). You must respect these restrictions and not share information that you access on the Platform. Prior to accessing the Platform you must confirm what restrictions your organization is subject to (e.g. geo-fencing) and you must not take any actions which have the effect, either directly or indirectly, of circumventing those restrictions.

4.6. Follow standard investigation procedures: You must follow standard Law Enforcement procedures when using the Platform, including taking appropriate steps to ensure information is accurate, up to date, relevant and complete.

5. Privacy

We respect privacy and take data protection very seriously, ensuring our practices comply with all relevant privacy legislation. For more detail, please see our Privacy Statement and if you still have any questions then please contact us at privacy@auror.co.

5.1. Your personal information: We capture personal information about you when we provide you with an account and access to the Platform. That may include your name, email address and other relevant details. Your activity on the Platform is also logged and may be reviewed by your organization and by us.

5.2. Personal information about others: User Content that you add to the Platform will often contain personal information of individuals involved in the events being recorded. That may include an individual’s name and images or video footage of that person.

5.3. The personal information of witnesses, innocent bystanders, and Law Enforcement officers involved in an investigation may also be captured in User Content. You must use the tools in the Platform that enable you to block out innocent bystanders and witnesses to minimise the inadvertent collection of their personal information.

5.4. Data minimization and accuracy: You must ensure that all User Content that you add to the Platform is kept to a minimum and is directly relevant to the individual or event being recorded. If you become aware that any information you upload to the Platform is no longer accurate (including out-of-date information) you must use the tools in the Platform to remove such information.

5.5. Communicating your collection of personal information: You must comply with your jurisdiction’s privacy laws when collecting personal information, including information that is classified as “sensitive”. Communication of information about how, why and when you collect your customers’ personal information is not only usually a requirement of most privacy laws but is also important for ensuring a transparent approach that helps maintain the trust of your customers (where you are a retail user) and the wider community. You should clearly communicate that you are collecting personal information with prominent, appropriate signage when you use technology like CCTV in stores and give individuals the ability to access more detailed information about your organization's privacy practises in a written privacy policy.

5.6. If you are based in the United Kingdom and/or are subject to the UK GDPR and the UK Data Protection Act 2018, then the additional GDPR Terms set out here apply.

5.7. Insights using anonymised statistical data: We may create anonymised statistical data and insights from User Content and Platform usage information, including through aggregation. We may use this anonymised data to share valuable insights with you, to provide and improve the Platform, to develop new services or product offerings, to identify business trends and for other uses that we communicate to you.

6. Security

Information security is critical to the operation of the Platform, so it’s something we care about a lot.

6.1. Data security: Auror maintains robust and effective controls over the security, availability, confidentiality and processing integrity of the Platform. All information in transit to and from Auror is encrypted. While we take reasonable steps to preserve the security of all information, no method of electronic storage is completely secure so we cannot guarantee absolute security and you transmit information to us and download information at your own risk. 6.2. Login and password security: You have an important role to play when it comes to keeping information on the Platform safe. You’re responsible for protecting your username and password from being stolen or misused and you must never share those details with any other person. Our service has minimum password standards but you need to ensure your passwords are very strong and not easily guessed. The stronger the password the better! Please let us know immediately if you realise there’s been any unauthorised use of your password or any breach of security of your account or the email address linked to it.

6.3. Account security features: We may introduce security features to make your account more secure and we may require you to adopt some or all of these features. Where we provide optional security features, you’re responsible (meaning we’re not liable) for any consequences of not using those features. We strongly encourage you to use all optional security features.

7. Intellectual Property Rights

7.1. What we own: We’ve worked hard to design and build a great Platform to help you reduce crime. Please respect our hard work and don’t copy or misuse the Platform in any way. We own the Platform unless otherwise stated, including all rights in its design, compilation, lay out, graphics and look and feel. Excluding any content owned by others, we also own rights in copyright material, trade marks, designs, inventions, and other intellectual property on the Platform.

7.2. If you want to use our logo or other intellectual property, please get in touch with us first.

7.3. You agree not to:

  • copy, distribute, modify, adapt, reproduce, disassemble, decompile, reverse engineer or make derivative works of any of the material on the Platform or use any of our intellectual property rights in any way not expressly permitted by us

  • access or search the Platform by any means other than the Platform’s publicly supported interfaces (for example by “scraping”)

  • re-package, re-sell, lease or sublicense any aspect of the Platform (including the information on it) in any way not expressly permitted in these Terms

  • use the Platform to share any unsolicited communication, promotion, advertisement or spam.

8. Cookies and Tools

8.1. Cookies: A “cookie” is a small data file sent to your browser that may then be stored on your system for later retrieval. We may use cookies to provide a better experience when you use and return to the Platform. Many of our service providers rely on them to provide important aspects of the Platform, for things like authentication for example.

8.2. Other tools: We may use other tools to help make our Platform better for you, including:

  • Full Story, Catalyst or similar tools, which uses screen recording to help us understand how you actually experience and use the Platform. This makes it easier for us to know what to improve, to help you if something goes wrong and to know where to best spend our time and energy making Auror great for you. These tools don't record any User Content.

  • Intercom, which powers the messenger and Help Centre in the Platform to provide real-time support for a great User experience.

  • Churn Zero, Pendo or similar tools, which tracks the most (and least) used features on the Platform so we can understand what to build next and where training or support might be needed to help you get the most out of the Platform. These tools don’t record any User Content.

9. Termination and Suspension

If you breach these Terms, we may end or suspend your access to the Platform immediately.

9.1. Termination or suspension: We reserve the right at our discretion to terminate or suspend your access to the Platform at any time without notice to you where we reasonably believe that:

  • you or your organization has breached these Terms or authorised, encouraged, facilitated or instructed others to breach the Terms

  • you or your organization has misused the Platform or your actions are likely to have a negative impact on Auror, the Platform, Platform users or the wider community.

We will also terminate your access to the Platform if our agreement with your organization is terminated for any reason.

9.2. Remediation: If we ask you to fix any identified breach and you don’t do so in the time frame we give you, then we reserve the right to terminate your access to the Platform at our discretion.

10. Limitation of Liability

This section sets out what we are - and aren’t - responsible for.

10.1. No warranties: We don’t provide any express or implied warranties in relation to the Platform, including any implied warranties of non-infringement, merchantability or fitness for a particular purpose. We explicitly disclaim any warranty that the Platform will be secure, available continuously, error free or free of any computer bugs, viruses or malicious code. We’re not liable for the consequences of any action you take or don’t take on the basis of information on the Platform.

10.2. Limitation of liability: Except for any liability that we can’t exclude or limit by law, we exclude all liability for any loss, damage, cost, expense or injury that you experience in connection with your access to or use of the Platform (or the content on or accessed through it), including without limitation any indirect, consequential, incidental, punitive, exemplary or special loss, damages or expenses.

10.3. Data loss: While we adhere to best practice policies and procedures to prevent loss of information, we can’t and don’t guarantee that information will not be lost. That means our liability for any loss of information, however caused, is strictly limited to taking reasonable steps to try and recover that data from our available backups.

10.4. You indemnify us: If a third party makes a claim against us relating to your use of the Platform and/or any User Content in breach of these Terms or our Privacy Policy, you agree to indemnify us and our employees against all losses, costs (including legal costs), expenses, demands, damages and liability except to the extent we’re at fault. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, which shall not excuse your indemnity obligations.

11. Data subject information and correction requests

11.1. Data subject requests: The ultimate responsibility for providing individuals with any associated data captured within the Platform is the organization that owns the data. Any requests from a person whose information may be captured in User Content will need to be sent to the organization who owns the User Content to determine the release of such information to that person. Any requests sent directly to Auror will be passed on to the relevant organization if identified. Auror will not make any determination on information requests, or the release of data to a third party.

11.2. Correction or deletion requests: If a person requests the correction of, or deletion of, any User Content or data within the Platform, a User from the relevant organization may agree to such a request, or it may add a comment on to the applicable User Content within the Platform. This is the responsibility of the User and not Auror. Auror will not make any determination on correction or deletion requests, or on objection of data processing requests.

12. Important Housekeeping

These might not be the most exciting terms but they still cover some important issues.

12.1. Jurisdiction and governing law:

These Terms and any dispute connected with this Platform are governed by and must be interpreted in accordance with the applicable laws of the country from which you have signed up to access the Platform as follows:

12.2. Changes to these Terms: We may need to change or update these Terms from time to time, so please keep an eye on this page for updates. We’ll make every effort to communicate material changes to you via email or through the Platform but we won’t bother you if we’re just fixing typos or the changes are inconsequential. If you keep using the Platform after we’ve changed the Terms, you will be considered as having accepted those changes.

12.3. Enforcement of terms: If any part of these Terms is or becomes illegal, invalid or unenforceable in the relevant jurisdiction, we’ll ignore that part but everything else will remain enforceable.

12.4. Interpretation: Words like ‘include’ and ‘including’ are not words of limitation and where anything is within our discretion we mean our sole discretion.
